THIS DAMAGE WAIVER IS NOT INSURANCE. PURCHASING THIS DAMAGE WAIVER IS OPTIONAL AND NOT REQUIRED IN ORDER TO RENT ITEMS ON CLOUD OF GOODS MARKETPLACE (COG). The terms of this damage waiver are subject to our Rental Policy, Privacy Policy, and Terms of Use.

For an additional fee payable via Cloud of Goods to COG’s local rental shop partner who’s fulfilling the order, you may purchase a damage waiver to cover applicable damages to eligible rented items during the rental period. This damage waiver is available only for the items covered by a damage waiver by our local rental shop partner who is fulfilling your order. If you are seeing the option to add the damage waiver to your rental, that means the local rental shop(s) servicing your order supports a damage waiver option for the product(s) in your shopping cart.

Cloud of Goods, and the local rental shop partner who’s servicing your rental, agrees, subject to the exclusions listed below, to waive your responsibility for any physical damage to a rental item occurring during the rental period if you subscribe to the damage waiver option at the time of initiating the rental. You understand and agree that under Cloud of Goods rental agreement and policies, any fees or expenses due to damages that are not covered by this damage waiver will be charged to and are immediately payable to Cloud of Goods by the Borrower.

Exclusions:
The damage waiver does not apply or is invalid where:

1. the damage waiver is caused by:
   1. Borrower’s intentional, willful, wanton, or reckless conduct;
   2. operation of a vehicle while under the influence of drugs or alcohol;
   3. exposure of the rental item to water or other liquids, where such exposure is not the intended use of the rental item;
   4. use of a rental item in a manner that violates federal, state, or local law; or
   5. Borrower’s failure to exercise ordinary care to prevent damage while in possession of the item.
2. the Borrower takes the rental item outside of the United States;
3. the Borrower provided fraudulent information to Cloud of Goods;
4. the Borrower refuses to reasonably cooperate with Cloud of Goods, insurance companies, or governmental entities in the investigation or recovery of any rental item reported by Borrower as damaged under the damage waiver.
5. Loss and theft are not covered under this damage waiver and the borrower is responsible for paying the reasonable market value of the item(s) lost or stolen during the rental period.
